DENVER — A Colorado state representative faces charges of driving under the influence, the Denver Police Department said.
Dan Pabon, a Democrat from Denver, was arrested Thursday night at Colfax Avenue and Glenarm Place, accused of a DUI.
According to the probable cause statement written by the officer, Pabon’s speech was slurred, his eyes were bloodshot and he was losing his balance.
The officer described Pabon’s breath as having “a strong odor of an unknown alcoholic beverage.” Pabon was arrested after he agreed to a standard field sobriety test and failed it, according to the officer’s statement.
The summons shows Pabon also is accused of making an improper turn and having the wrong plates on his vehicle. Pabon was processed and released. He’s scheduled to be arraigned on April 18.
“On the evening of March 17th, I was pulled over by a member of the Denver Police Department. I fully cooperated with the officer’s requests. And I will continue to remain fully cooperative throughout this process. I regret the distress this has caused my family, my friends and my constituents,” Pabon said in a statement.
Pabon, 38, represents District 4 in the northwest part of the city. He was first elected to the Colorado House of Representatives in 2010.
He has been involved with legislation regarding drunk driving in the past. This year, he passed a bill involving DUI victim impact panels. He worked on felony DUI legislation last year.
“It is unlikely that a jail sentence will result from this” and that’s “because he took a blood test. It will probably be four to six weeks before that blood result is finished,” DUI attorney Jay Tiftickjian said.
Proban is captain of the House Beer Caucus. House Democrats did not issue a formal statement in response to the charges. Pabon reported to work Friday before news of the arrest was made public.
