GREELEY, Colo. — Four years after Ashley Fallis died in her home in Erie, her husband went on trial Wednesday for her death. Opening statements were given by prosecutors and defense attorneys at a Weld County courthouse.

Tom Fallis is accused of killing Ashley Fallis on New Year’s morning in 2012.

Her death was initially ruled a suicide. But police reopened the case after a FOX31 Denver Problem Solvers investigation revealed new evidence, including an alleged confession overheard by a neighbor.

Tom Fallis, a former Weld County sheriff’s jail deputy, was indicted by a grand jury for second-degree murder.

Ashley Fallis’ family believes police and sheriff’s investigators hid evidence, and tried to cover up for Tom Fallis.

Tom Fallis’ lawyers say Ashley Fallis committed suicide and will introduce a suicide note that was written about 18 months before her death.

Tom Fallis moved to Bloomington, Ind., with his three children after his wife’s death but was brought back to Colorado to stand trial. The children are expected to testify.
