JEFFERSON COUNTY, Colo. (KDVR) — After millions of people signed an online petition urging clemency for the man sentenced to 110 years in prison in a deadly crash on Interstate 70, the district attorney filed a motion to reconsider the sentence.

Attorneys for Rogel Aguilera-Mederos will join prosecutors in court on Monday to decide when the case will be heard.

First Judicial District Attorney Alexis King filed a motion Friday asking the court to set a hearing to reconsider the sentence, and she filed another motion Tuesday to expedite the matter. A spokesperson for the DA’s office said this action “essentially reopens the case.”

The motion states, “As Colorado law required the imposition of the sentence in this case, the law also permits the Court to reconsider its sentence in an exceptional case involving unusual and extenuating circumstances.”

This comes after Polis confirmed in a news conference Tuesday that the lawyer for Aguilera-Mederos turned in a clemency application to his office.

Responding in Spanish to a question from a Spanish-language media outlet, Polis said, “We just received the application yesterday evening from his attorney and my legal team is reviewing it right now. When we have a decision, we will announce it.”

“This some political scrambling is what it is,” said James Colgan, an attorney for Aguilera-Mederos. “They’ve taken some political heat for the trophies between the prosecutors,” Colgan said, referring to a deputy district attorney’s Facebook post showing a brake shoe fashioned as a trial memento.

“That’s why they are trying to get out in front of this,” Colgan said.

The story has garnered enough attention nationally that Kim Kardashian West has asked Polis to commute Aguilera-Mederos’ sentence.
