Judge rules on dozens of motions as murder trial against Tom Fallis looms

WELD COUNTY, Colo. — The murder trial against Tom Fallis is set to begin in 10 days. On Thursday, the judge ruled on dozens of pretrial motions and the decisions cut both ways.

Last month, the judge heard from more than a dozen people, including Ashley Fallis’ mother, friends and a man with whom she was reportedly having an affair. Both sides filed motions trying to get certain testimony excluded from the trial.

On Thursday, the judge ruled most of the statements Ashley Fallis reportedly made to friends, family and co-workers about her pregnancy, miscarriage, depression and the state of her relationship will be allowed into testimony.

Some of it the defense wanted in, but others were victories for the prosecution. The judge is not going to allow much of what was said by the man Ashley Fallis is accused of having an affair with. In the end, that decision could be good for either side.

But in a small win for the defense, the judge won’t let the jury hear the allegations of abuse by Tom Fallis’ first wife. And after a lot of legal wrangling, prosecutors confirmed Thursday night that Fallis’ children will take the stand.

The judge also denied the defense`s request to move the trial out of Weld County. He will also allow extended media coverage.
