Boulder resident who killed CU student intruder won’t be charged

BOULDER, Colo. — A Boulder homeowner will not be charged after fatally shooting Roberto Zamora, a University of Colorado student who broke into his home on Pima Court on May 4, the Boulder District Attorney’s Office announced Wednesday.

The district attorney’s office determined the shooting fell under the protection of Colorado’s “make my day” law.

Evidence found in an investigation showed Zamora attempted to enter other homes before he entered the house at 98 Pima Court.  He shattered a glass door and attacked the homeowner.

“Whenever a firearm is used and an individual is injured or killed (in conjunction with the “make my day” law), the police and my office will always conduct a thorough investigation to determine exactly what occurred,” the district attorney’s office said.

Zamora was reportedly under the influence of at least one drug at the time of the incident but final toxicology results were pending.

Neighbors have identified the homeowner who killed Zamora as Jim McCain.
