GREELEY, Colo. — Opening statements were delivered Wednesday in the murder trial of former Weld County sheriff’s Deputy Tom Fallis.

He’s accused of shooting his wife, Ashley. Her death was originally ruled a suicide, but a FOX31 Denver Problem Solvers investigation found evidence that led to prosecutors reopening the case.

“I didn’t shoot my wife,” Fallis said during police questioning after she died.

He was indicted by a grand jury for her death early on New Year’s Day in 2012 in the couple’s home in Evans.

“It is him who pulled the trigger,” a prosecutor said during opening statements Wednesday.

Fallis had moved to Indiana, where he was arrested and brought back to Colorado to stand trial.

Defense attorney’s argue that Ashley Fallis had a history of mental illness and that she was suicidal that night after having suffered a miscarriage that morning. Prosecutors charge Fallis was upset about his wife’s marijuana smoking but that she was not suicidal.

 

 

 

The trial resumes Thursday morning.
