AULT, Colo. — A sad update tonight to a FOX31 Problem Solvers Investigation we first told you about on Wednesday.
55-year old Mateo Martinez died Saturday morning from a brain injury he suffered during a street fight Oct. 2 in the small town of Ault, near Greeley.
As we previously reported, the Weld County District Attorney’s office is now deciding whether to charge the husband and wife who assaulted Martinez.
Doug and Stacy Glaze were originally cited with disorderly conduct after police say the couple was drunk and picked a fight with Martinez for parking in front of their house on a public street.
When Martinez lost consciousness six weeks later, detectives told the Martinez family they could not arrest the Glaze’s for a new crime.
Police said the couple had already paid their $150 fine for a city ticket and it would be double jeopardy to re-arrest them.
After FOX31 started asking questions, prosecutors agreed circumstances had changed and it would not be double jeopardy to file new charges.
But no decision has been made yet whether to do so.
Weld County District Attorney Michael Rourke refused to give a deadline for making a charging decision but suggested it won’t take more than a month.
There is an online petition demanding charges be filed against Doug and Stacy Glaze.
There is also a GoFundMe page set up for the family of Mateo Martinez, who was locally known as the Munchie Man because he had a mobile food cart and would sell Mexican food around town.
